DRC: Minister in charge of Justice banned from leaving Kinshasa

Kinshasa, 16 June 16th, 2025 (CPA)- Justice Minister Constant Mutamba has been banned from leaving Kinshasa, the capital of the Democratic Republic of Congo, by the public prosecutor at the Court of Cassation, according to a letter sent to the Directorate General of Migration consulted by CPA on Monday.

‘I hereby inform you that, in accordance with article 83 paragraph 1 of the organic law of February 19th, 2013 on proceedings before the Court of Cassation, I have decided to ban the above-mentioned Mutamba from leaving the city of Kinshasa,’ reads the letter, signed by Attorney General Firmin Mvonde. According to the source, this ban is the result of the authorization sought and obtained from the National Assembly to indict Minister Mutamba for the misappropriation of funds allocated to the construction of a prison in Kisangani, the capital of Tshopo, in the east of the DRC.

The Minister in charge of Justice is also being prosecuted in the same case for embezzling funds allocated to compensate victims of the six-day war between the Ugandan and Rwandan armies on Congolese soil from June 5th to 10th, 2000. In his letter of Wednesday, June 11th, 2025 informing the Minister of Justice of the closure of his indictment, Attorney General Mvonde invited him to remain ‘serene for the continuation of the proceedings’, while reassuring him that ‘as a good legalist, he has confined himself solely to the legal requirements, without regard to any other consideration’. The Minister in charge of Justice was interviewed twice at the offices of the General Prosecutor’s Office at the Court of Cassation. The conclusions of the public prosecutor’s investigation led to an assertion of misappropriation of public funds, which prompted him to request, on Monday, June 9th, 2025, that the National Assembly authorize the impeachment of Minister Mutamba.
