Kinshasa, June 17th, 2025 (CPA).- The management and the operation of public roads of provincial, urban and local interest fall ‘exclusively’ within the jurisdiction of the city of Kinshasa, capital of the Democratic Republic of Congo (DRC), has announced the minister responsible in a communique consulted by CPA on Tuesday.
« The management and the operation of public roads of provincial, urban and local interest fall under the exclusive jurisdiction of the province. This prerogative is exercised in strict accordance with the Article 204 of the Constitution and the law of July 31st, 2008, on the fundamental principles relating to the free administration of provinces, » it is read in this document signed by Alain Tshilungu, provincial minister in charge of Infrastructure and Public Works. ‘Consequently, any request for authorisation to use provincial and urban public road space must be submitted to the provincial Ministry in charge of Infrastructure and Public Works,’ the source has added.
‘This measure concerns, in particular, the laying of cables and pipes, the installation of temporary or permanent structures, and any other occupation affecting urban public roads,’ the document has specified. The provincial infrastructure minister’s statement has also reiterated that any authorisation granted outside this procedure ‘is null and void’ and exposes its authors to the penalties provided for by law. This statement has been published at a time when several cases of unregulated occupation of public road space are being dismantled, particularly pirate markets.
