Kinshasa, April 31, 2021 (CPA).- Kinshasa/Gombe Peace Court referred, to Monday, April 5th, 2021, the case between the public prosecutor and the civil party against Mrs. Florence Muleka, wife of Albert Yuma, in the case of false certificate of plot registration, at the end of the descent on the ground, on Wednesday, at the office of the registrar of real estate titles of Kinshasa Ngaliema.
The Peace Court has decided on the appearance, at the hearing of April 5th, 2021, of witness Didier Lema who had notarized the deed of sale and did not appear at the hearing on Wednesday.
Ngaliema peace court went down to the office of the registrar of real estate titles in Kinshasa Ngaliema, to verify the existence of the property deeds, which served as the basis for the registration certificate attacked for forgery in this case.
The descent on the ground at the office of the curator of real estate titles of Kinshasa Ngaliema allowed the Peace Court to come into possession of an act of recognition of November 11th, 2020 which proves the collection, by the late Jean Kaneka, of a sum of 90 thousand dollars from the hands of Mrs. Florence Muleka as an advance on 120 thousand American dollars of the total amount of the acts having served for the establishment of the attacked registration certificate.
For the lawyer of the civil party, Me Ntumba Mukendi Mpunga, this act of recognition is not a deed of sale adding that the custodian of real estate titles of Kinshasa Ngaliema, Kilanga Langa, had refused to notarize this deed and therefore could not establish the registration certificate.
Another discovery made by the Peace Court at the office of the registrar of real estate titles, a discharge dated May 4th, 2003, signed not by the late Jean Kaneka, but by a lady called Francine Kazadi, resident in Europe, presented by Ms. Muleka as being Ms. Kaneka.
Among the three witnesses cited at the hearing of March 22nd, 2021, only two appeared, namely the curator Kilanga Langa and the current custodian of real estate titles of Ngaliema, Pascal Katanga. ACP/Kayu/KJI
