Kinshasa: ‘Bad faith’ of one party in a building dispute deplored

Kinshasa, July 8th, 2025 (CPA).-The ‘bad faith’ of one party in a building case in Kinshasa, capital of the Democratic Republic of Congo (DRC), was deplored on Tuesday by a construction company owned by a Jewish investor during an interview with its lawyer and the CPA. ‘It is bad faith on the part of Mr. Kabamba Mulumba, known as Kamul Inter, who arranged with his children to take legal action against him in order to have the contract for the sale of a plot of land, which bound him to the Company Bleu Development SARL, cancelled, even though the contract provided for an amicable settlement in the event of a dispute,’ said Patrick Kakala Mondongu, legal counsel for the construction company. He specified that the contract between Bleu Development SARL and Mr Kabamba Mulumba, known as Kamul Inter, had been duly signed in 2016 for the transfer of the plot of land located on Avenue Uvira, in the commune of Gombe, north of Kinshasa, adding that an advance of USD 100,000 had been given to Kamul Inter, not including the USD 5,000 paid to him each month during the three years of construction.  ‘At the end of the construction, he refused the two apartments that were given to him, on the pretext that they were not worth USD 600,000 each, as agreed in the contract. To make matters worse, Kamul Inter even took the liberty of selling these two apartments, even though he had rejected them,’ he added. Bleu Development SARL has, for the time being, referred the matter to the Inspector General of Judicial and Penitentiary Services to prevent the enforcement of a ruling by the Gombe Court of Appeal, which was to be carried out by a bailiff who had ordered the occupants of the building to vacate the premises. « The request for communication of the file for the enforcement of judgment RCA 38.867/37.662/36.970/39.369  makes it possible to prevent the enforcement of the said ruling, in which the judges had fraudulently inserted a number that was not included, ordering the eviction of my client and all those who live in the Bleu Development Sarl building, » added Mr Patrick Kakala. He also deplored the manipulation of the justice system, given that the Head of State had insisted, during his second inauguration, on the neutrality of the justice system in the DRC, which must guarantee an improvement in the business climate.
