According to this document, the sale will be for cash only, with a proportional fee of 10% to be collected for the benefit of the Public Treasury. A public auction is a process by which a debtor’s assets are sold at auction. This procedure is initiated when the debtor has not paid their debts in accordance with a judgment or court order. The seized assets are then put up for auction to recover the amounts owed to the creditor. Three conditions must be met to proceed with a seizure and sale procedure. These include an enforceable title to allow for the implementation of forced execution measures; the movable assets must belong to the debtor; and the judicial commissioner must have a payment order. This order must be notified to the debtor, giving them eight days after receipt to settle their outstanding debt.
