Kinshasa, May 14th, 2026 (CPA).- A claim for payment of outstanding wages has been requested on Thursday, by a former employee against a company for wrongful termination of an employment contract, at the Matete Labour Court in the centre of Kinshasa, capital of the Democratic Republic of Congo (DRC), during a hearing. “The court must rule that the termination of this contract was unfair (…) You will declare this claim admissible and well-founded; Order Tokom Sarl to pay the outstanding wages as well as holiday pay; Order the company to pay the final settlement with notice, Also order the company to pay the sum of $45,000, payable in Congolese francs, for damages (…)”, has argued the lawyer of Paul Makala, a former employee of Tokom Sarl. He has indicated that he had entered into a verbal employment contract with the aforementioned company and had never been subject to disciplinary proceedings. On October 28th, 2025, the employer had decided to terminate his contract following an irregular disciplinary procedure, citing an imaginary regulatory provision on the alleged grounds of prolonged unjustified absence, he has noted. “The certificate of termination of service will be issued to him without payment of the final settlement,” has explained the claimant’s lawyer. For its part, the company Tokom Sarl, the defendant, has promised to submit its submissions within the statutory time limit. “You will notice with us that the defendant has promised to submit the files; we would ask the court to provide us with the file so that we may submit our written opinion,” has maintained the public prosecutor in his submission. “The court has granted the public prosecutor’s request and will provide you with the file within the time limit prescribed by law,” has declared Jean-Paul Lobanga, the presiding judge.
