Kinshasa, October 13th, 2025 (CPA).- A case between a worker and H.J Hospitals SARL, a hospital, has been adjourned on Monday for three weeks for summons by the Matete Labour Court in central Kinshasa, capital of the Democratic Republic of Congo (DRC), during a hearing. ‘The court is adjourning the case between Mr Moourad Afli and HJ Hospitals Sarl for three weeks for summons,’ has declared the presiding judge Kiama.
And to add: ‘The plaintiff (Moourad Afli) had summoned HJ Hospitals on September 29th, 2025. On that date, the public prosecutor was not present at the hearing, and a report of absence was established’. He has, furthermore, argued that the plaintiff should again regularise the proceedings with regard to the defendant if it wishes the latter to be summoned, given that at today’s hearing, HJ Hospitals had voluntarily refused to appear. The court has not been seized of the matter with regard to the defendant, but has been regularly seized of the matter with regard to the plaintiff. In the opinion of the public prosecutor, the summons of September 29th could not have eternal effect.
Thus, at today’s hearing, the summons had lapsed and had no effect. It should be noted that, in law, a summons is a formal document, often a warning injunction served by a bailiff, which requires a person to do something under penalty of legal sanctions. It serves to formally establish a request and to constitute proof of that request.
