Kinshasa: a woman seeks the suspension of a judgement on the liquidation of the matrimonial property regime

Kinshasa, June 23rd, 2026 (CPA). – A female buyer of a disputed plot of land has asked on Tuesday, to the High Court of N’djili, in the east of Kinshasa, capital of the Democratic Republic of the Congo (DRC), to suspend the enforcement of a judgement authorising the liquidation of the matrimonial property regime, because she had already acquired the said plot, during a hearing. The plot belonging to our client is situated at 89/B Malele Avenue, District 6, in the municipality of N’djili. They are in the process of selling the plot to divide the proceeds amongst themselves, despite the fact that my client had purchased it in due form.

“We are asking the court to suspend the decision authorising the liquidation of the matrimonial property regime, because this plot had been purchased by her client, Clarisse Usuka,” has declared Ms Tatiana Dembo. In response, lawyer Josue Lomena, defending the heirs Francine MaKengo, Jacqueline Makengo, Arthur Ngoy and Rose Zombiduku – all children of the late Roger Zombiduku has maintained that the disputed plot of land sold by one of the heirs forms part of the estate’s assets. Consequently, this sale must be cancelled.

‘The plot in dispute forms part of the estate of the late Roger Zombiduku; no sale could have been made without the consent of all the heirs. Consequently, your court will cancel this sale and confirm the judgement authorising the judicial liquidation of the matrimonial property regime,’ has added Mr Lomena. For his part, Mr Espoir Loyamba, the lawyer for Jonas Zombiduku—the eldest member of the family who is alleged to have sold a part of the plot has refused to plead because the court has rejected his application for a stay of proceedings.

“Given that your court has refused to grant us a stay of proceedings, we are withdrawing our appearance,” he has insisted. For his part, the prosecutor asked the court to annul the sale of the plot in question on the grounds of irregularity. “Your Honour, your court had authorised the liquidation of the matrimonial property regime, but at today’s hearing, the claimant is asking you to suspend the enforcement of the judgment authorising the liquidation. For us, the public prosecutor’s office, we ask this court to confirm the judgement that authorised the liquidation and to cancel the sale of the said plot of land as it is unlawful,” he has argued. The court has decided to take the case under advisement and will deliver its ruling within the time limit laid down by law. CPA/
