Eight cases were called and tried in the constitutional court

Kinshasa,  June 12th, 2021 (CPA).- The constitutional court, sitting in matters of constitutionality control, called and tried eight cases during a public hearing at its headquarters in the royal place of Gombe

Among these cases, only one followed the normal procedure while seven others were examined following the screening procedure which makes it possible to exclude from the normal course requests whose objects clearly do not fall within the competence of the Constitutional Court or those which are simply out of order.

The case enlisted under R. Const 1535 at the request of Mr. Justin Omokala Wemambolo, provincial deputy of the district of Lodja in the province of Sankuru asking the court to declare unconstitutional the resolution of the Provincial Assembly n.001 / S. 0.1 / AP / SANK / 2021 of April 14, 2021 authorizing the prosecution granted to the senior military auditor of the province of the former Kasai Oriental against him for violation of articles 19,27,107 of the Constitution 85,86 of the internal regulations of the Provincial Assembly of Sankuru and 9 of Law No. 08/012 of July 30, 2008 on fundamental principles relating to the free administration of the provinces, followed the normal procedure.

For this cause, the court declared itself competent and declared the request admissible and founded and declared null resolution n.001 / S.0.1 / AP / SANK / 2021 of April 14, 2021 authorizing the prosecution granted to the military auditor. superior of the province of the former Kasai Oriental against Mr. Justin Omokala Wemambolo.

On the other hand, the Constitutional Court concluded in the screening procedure the cases enlisted under R.Const 548, 1070, 1428, 1546, 1559, 1562, 1567 which were processed according to the simplified screening procedure. ACP/
